The State Water Resources Control Board’s, Office of Enforcement (OE) has an opening for a permanent full time Attorney in its Regional Water Board Programs Legal Unit to assist with water quality-related enforcement work. OE acts as legal advisor to both the State Water Board and the nine Regional Water Boards in all matters relating to enforcement. The position requires frequent adversarial engagement with the regulated public, stakeholders, non-governmental organizations and other government agencies. The position location is 801 K Street, Sacramento, CA 95814. The building is a short 5-minute walk to CalEPA headquarters and is conveniently located near public transportation. 801 K Street has on-site permitted parking for a monthly rate and secure bicycle parking.

Duties:
Under the direction of an Assistant Chief Counsel and consistent with good customer service practices and the goals of the State and Regional Board’s Strategic Plan, the incumbent is expected to handle a diverse case load, be courteous and provide timely responses to client staff, follow through on commitments, and to solicit and consider client input when completing case assignments. Specific responsibilities include:

Assist in all aspects of the investigation and prosecution of enforcement matters arising out of the State Water Board and Regional Water Boards’ water quality enforcement programs, including providing legal counsel and representation during settlement negotiations and administrative hearings. Support Attorney General’s Office and other civil and/or criminal prosecuting agencies with Water Board litigation matters, as needed.

Interpret statutes and regulations related to enforcement matters; conduct legal research; prepare legal documents including opinions, memoranda, case briefs, reports, summaries, etc. Assist Water Board management in creating and implementing new Policy directives and tracking enforcement cases to ensure that actions are implemented in a manner consistent with the Enforcement Policy.

Draft and/or review legislation, regulations and other documents related to enforcement; review documents and prepare correspondence pursuant to Public Records Act requests and civil discovery requests. Review pending legislation and bill analyses of interest to the Water Boards’ enforcement programs and provide assistance to the Water Board’s Office of Legislative Affairs

Salary information – CalHR salary rules allow appointment at the entrance rate (Cal. Code Regs., tit. 2, § 599.673) of a classification. For classes with alternate ranges, placement is based on education/experience.
